Terms of Use and Sale

1. Purpose
These Terms of Use and Sale (hereinafter "Terms") govern access to and use of the spira mobile application (hereinafter "the App"), published by spira technologies (hereinafter "the Publisher"). Any use of the App constitutes unconditional acceptance of these Terms.
2. Definitions
"User": any individual using the App. "Coach spira": the AI-powered training assistant integrated into the App. "Generated Content": any workout program, suggestion, or recommendation produced by the App's artificial intelligence features. "Premium Subscription": a paid plan providing access to all App features, including Coach spira and advanced program generation.
3. Acceptance of Terms
Using the App implies full and unconditional acceptance of these Terms. If you do not agree, please do not use the App. The Publisher reserves the right to modify these Terms at any time. Users will be notified of any material changes via an in-app notification. Continued use after modification constitutes acceptance of the updated Terms.
4. Service description
spira is a mobile fitness application offering: creation and tracking of personalized workout programs; an AI-powered smart coach (Coach spira) providing exercise suggestions and guidance; health metric tracking (steps, active calories, weight) via Apple HealthKit and Google Health Connect integration; social features to add friends and exchange messages; and a complete history of sessions and progress.
5. Registration and user account
Access to the App requires creating an account via email address or Google sign-in. Users agree to provide accurate information (first name, last name, email address, date of birth, gender) and to keep their credentials confidential. Users are solely responsible for all activity on their account. In case of unauthorized use, the User must notify the Publisher immediately. Users must be at least 16 years old to create an account.
6. Subscriptions and pricing
The App offers a free version with limited features and a Premium Subscription available as a monthly or annual plan. A 7-day free trial is offered to new Users. Current pricing is displayed before any purchase. Subscription and payment take place directly on spiraapp.com through our providers RevenueCat (Web Billing) and Stripe; accepted methods are credit/debit card, Apple Pay and Google Pay. spira stores no banking data, which is processed exclusively by Stripe (PCI-DSS certified). Subscriptions renew automatically at the end of each period unless cancelled before the renewal date from the User's account area or by request to no-reply@spiraapp.com. Refunds are handled directly by the Publisher, in accordance with applicable law and the right of withdrawal (section 7).
7. Right of withdrawal
As this is a distance sale, the User is in principle entitled to a 14-day withdrawal period. However, in accordance with applicable consumer protection law, this right cannot be exercised for the supply of digital content not delivered on a tangible medium where performance has begun with the User's prior express consent and express waiver of the withdrawal right. By subscribing to a Premium Subscription and requesting immediate access to the service, the User gives such express consent and acknowledges losing the right of withdrawal. During the 7-day free trial, the User may cancel at any time at no cost.
8. Artificial intelligence features
The App integrates artificial intelligence features (Coach spira, program generation) powered by third-party language models. The User acknowledges that: Generated Content is provided for informational purposes only and does not constitute medical advice, diagnosis, or prescription; suggestions may contain inaccuracies and should be evaluated with care; conversations with Coach spira are processed by third-party services to generate responses; the Publisher does not guarantee the accuracy, relevance, or completeness of Generated Content. The User is solely responsible for how they use Generated Content.
9. Health data
The App may access, with the User's explicit consent, the following health data via Apple HealthKit or Google Health Connect: daily step count and active calories burned. This data is used exclusively to display statistics within the App and is never sold, shared for advertising purposes, or transmitted to unauthorized third parties. The User may revoke this access at any time from their device settings. Weight and body measurements entered manually in the App are stored securely and associated with the User's account.
10. Social features
The App offers social features allowing users to add friends and exchange messages. Users agree not to use these features to distribute unlawful, offensive, harassing, or otherwise inappropriate content. The Publisher reserves the right to remove any content that violates these Terms and to suspend or delete the account of any offending User, without notice or compensation.
11. Personal data and privacy
The Publisher collects and processes the following personal data: identification data (name, email, date of birth, gender); body metrics (height, weight); activity data (workout history, performance, progress); health data (steps, calories, with consent); Coach spira conversation data; and technical data (device, app version). This data is processed in compliance with the General Data Protection Regulation (GDPR). The legal basis for processing includes contract performance (service delivery), consent (health data, notifications), and legitimate interest (service improvement). Data is hosted within the European Union via Google Cloud (Firebase) services. Users have the following rights: access, rectification, erasure, restriction of processing, portability, and objection. These rights may be exercised by email at no-reply@spiraapp.com or directly from the App settings (account deletion). Data retention is limited to the lifetime of the account, plus any legally required retention periods.
12. Third-party services
The App uses the following third-party services: Google Firebase (authentication, data storage, hosting); RevenueCat (subscription and in-app payment management); Brevo (transactional emails: account verification, password reset); and artificial intelligence providers for Coach spira features. Use of these third-party services is subject to their own terms of use and privacy policies. The Publisher ensures that these providers offer adequate data protection guarantees.
13. Intellectual property
All elements of the App (design, text, images, logos, software, algorithms, the "spira" trademark) are protected by intellectual property law and remain the exclusive property of the Publisher. Any unauthorized reproduction, representation, modification, or exploitation, in whole or in part, is strictly prohibited. Users retain ownership of their personal data and content posted through social features. By posting content, Users grant the Publisher a non-exclusive, free, worldwide license for the purposes of operating the service.
14. Liability and limitations
The App is in no way a substitute for professional medical advice. Before starting any workout program, Users are advised to consult a physician, especially if they have a pre-existing medical condition. The Publisher disclaims all liability for injury, bodily harm, or worsening of a health condition resulting from the use of proposed programs. The Publisher does not guarantee uninterrupted availability of the App and shall not be held liable for temporary interruptions due to maintenance, updates, or circumstances beyond its control. The Publisher's liability is limited, to the fullest extent permitted by law, to the amounts actually paid by the User in the preceding 12 months.
15. Service availability and modifications
The Publisher endeavors to keep the App available 24/7 but cannot guarantee it. Access may be temporarily suspended for maintenance, updates, or force majeure. The Publisher reserves the right to modify, update, or discontinue any or all App features, with reasonable notice for material changes affecting Premium subscribers.
16. Termination
Users may delete their account at any time from the App settings. Deletion results in the permanent erasure of all data associated with the account, subject to legal retention obligations. Cancellation of a Premium Subscription is done from the User's account area on spiraapp.com or by request to no-reply@spiraapp.com; the subscription remains active until the end of the already paid period, after which it is not renewed. The Publisher may terminate or suspend an account in case of violation of these Terms, without notice or compensation.
17. Governing law and disputes
These Terms are governed by French law. In case of dispute, the parties agree to seek an amicable solution before taking legal action. In accordance with consumer protection regulations, Users may use a free consumer mediation service. Failing amicable resolution, the competent courts shall be those of the User's place of residence, in accordance with standard legal rules.
